These Messaging Terms & Conditions (“Terms”) govern your use of the automated text message marketing program (“Messaging Service”) provided by Chesnut Property Solutions, a brand owned and operated by BNA1 LLC (“we,” “us,” or “our”). By opting in and participating in the Messaging Service, you agree to be bound by these Terms, which are incorporated into and governed by our Terms of Use and Privacy Policy (collectively, the “Terms Documents”). In the event of any conflict, these Messaging Terms shall prevail.

1. Consent to Receive Messages: By signing up for our Messaging Service, you agree to receive recurring automated promotional and personalized marketing messages (including SMS and MMS), such as cart reminders, from Chesnut Property Solutions. Messages may be sent using an automatic telephone dialing system to the mobile number you provide or designate.

• Consent is not a condition of any purchase.

• Message and data rates may apply.

• Message frequency may vary.

• We reserve the right to alter message frequency or the short code/phone number from which messages are sent, with prior notification to you when feasible.

• Not all mobile devices or carriers may support these messages, and delivery cannot be guaranteed.

• We and our service providers, including Launch Control, and supported carriers, are not liable for delayed or undelivered messages.

• We currently support message delivery to major carriers including AT&T, Verizon Wireless, Sprint, T-Mobile, and other national and regional carriers.

2. Opt-Out Instructions: You may opt out at any time by replying with one of the following keywords to any message you receive from us:
STOP, END, CANCEL, UNSUBSCRIBE, or QUIT.

After opting out, you will receive a final confirmation message. Please note that unsubscribe requests without these keywords may not be recognized or processed.


3. Rejoining Instructions: If you have opted out and wish to rejoin, you can text START or YES to the shortcode or phone number, or sign up again through our website or other enrollment channels.

5. Carrier Liability Disclaimer: We deliver messages via supported carriers, including AT&T, Verizon Wireless, Sprint, T-Mobile, and other major national and regional carriers. Neither Chesnut Property Solutions, BNA1 LLC, our service providers, nor carriers are responsible for delayed or undelivered messages. Delivery depends on your carrier and device capabilities.


6. Message and Data Rates Disclaimer: Message and data rates may apply for messages sent or received. Message frequency may vary depending on your interactions with the program. You are responsible for any fees charged by your wireless carrier.


7. Privacy Policy: Your use of the Messaging Service is governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.


8. Compliance with Industry Standards: Chestnut Property Solutions complies with all applicable laws and industry standards, including the Telephone Consumer Protection Act (TCPA) and other relevant regulations governing SMS marketing communications.


9. Legal Compliance and Terms:

By participating in this Messaging Program, you confirm you are the authorized user of the provided phone number and consent to receive automated marketing messages. Consent is not required to purchase any goods or services. BNA1 LLC reserves the right to modify message frequency, change the sending number, or terminate the program at any time in compliance with applicable laws. You will be notified of significant changes when feasible.
